  1. Introduction

Thank you for considering a job opportunity at DataSentics, a.s. To process your application, we need to process some of your personal data.

This Candidate Privacy Policy ("Policy") explains how we collect, use, and process your personal data during the hiring process. It also informs you of your rights regarding your personal data. We are committed to full transparency in how we handle your personal data, including any special categories of data. This Policy complies with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC ("GDPR").

  1. Personal Data We Collect From You

We process your personal data that we have obtained directly from you, through communications prior to the recruitment process, during the recruitment process, through related communications and publicly available information.

We process the following personal data:

  • Contact information – your name, email address, phone number, city, country, and any other contact information you provide;
  • Background information – your CV or resume, including cover letter, academic qualifications, work experience, transcripts, etc;
  • Reference information that you have provided to us, or that a former employer or a reference person has provided with their consent. We will contact reference persons only if you agree to it.
  • Identification information, such as your date of birth or address.
  • Publicly available information, e.g. from your LinkedIn profile.
  • Other information you provided to us during the hiring process.

 

  1. Purpose of Processing Your Personal Data and Legal Basis for Processing

The purpose of processing your personal data is:

  • to select the most suitable candidate during the recruitment process;
  • to enter into an employment contract or an agreement on work performed outside of employment or other relevant contract with selected candidates; and
  • to protect our legitimate interests or the legitimate interests of a third party (such as protecting property, asserting rights and claims arising from the fulfillment of a contractual relationship, and communication).

Processing personal data for these purposes is necessary for:

  • the fulfillment of a contract to which the data subject is a party, or to take steps at the request of the data subject prior to entering into a contract, in accordance with Article 6(1)(b) of GDPR; and
  • the purposes of the legitimate interests pursued by the controller or a third party, in accordance with Article 6(1)(f) of GDPR.

If we need to process your personal data beyond the obligations established by legal regulations, or beyond our legitimate interests or the legitimate interests of a third party, we will always seek your consent in advance.

  1. How we use your personal data

We will use the information we collect about you for the following purposes:

  • to communicate with you throughout the hiring process;
  • to assess your qualifications, skills, and suitability for the considered job;
  • to consider you for, and inform you about other job opportunities;
  • to verify your information and carry out reference checks;
  • to prepare your employment or other agreement if you are offered a job with us;
  • to comply with applicable regulations, legal processes or enforceable governmental requests.

In addition, we process your data (on an aggregated level) to perform analyses in order to understand, maintain, evaluate and improve our hiring process.

  1. Automated decision-making

If you upload your CV on our website, we use automated tools and artificial intelligence to analyze your skills and experience. Based on this analysis, the system automatically recommends suitable job opportunities to you. No further automated decisions or classifications of applicants are performed. 

  1. Sharing your personal data

We share your personal data only within our organization to carry out the activities specified in this Policy. Additionally, we may transfer your personal data to third-party service providers, such as recruitment agencies and providers of recruitment tools.

If personal data collected within the EU/EEA is transferred to third parties located outside the EU/EEA, we ensure that such transfers comply with applicable data protection laws. In particular, we implement appropriate contractual, technical, and organizational safeguards, such as the Standard Contractual Clauses (SCCs) approved by the European Commission.

  1. Data retention and deletion

If your job application is successful, the relevant information collected during the hiring process will become part of your employment or subcontractor record and will be retained in accordance with our privacy policies for employee and subcontractor data.

 

If your application is unsuccessful, we will delete your personal data after the hiring process is closed, at the latest within one year.

 

However, if you provide consent for us to retain your personal data in our talent pool for future job opportunities we will store your data for 5 years from the date it was provided.

 

  1. Your Rights Regarding the Processing of Your Personal Data
  • Right of Access: You may request access to the personal data we process about you.
  • Right to Rectification: You may ask us to correct any inaccurate or incomplete personal data concerning you.
  • Right to Erasure: You may request the deletion of your personal data if:
    i) It is no longer needed for the purposes it was collected;
    ii) You withdraw your consent and there is no other legal basis for processing;
    iii) You object to automated decision-making or data processing, and no overriding legitimate reason exists;
    iv) Your personal data has been processed unlawfully.
  • Right to Restriction of Processing: You may request us to limit the processing of your data if:
    i) You contest its accuracy, allowing time for verification;
    ii) The processing is unlawful, but you prefer restriction over deletion;
    iii) We no longer need the data, but you require it for legal claims;
    iv) You have objected to processing, pending verification of overriding legitimate grounds.
  • Right to Data Portability: You may request your personal data in a structured, commonly used, machine-readable format, provided this does not affect others’ rights and freedoms.
  • Right to Withdraw Consent: You may withdraw your consent to data processing at any time.
  • Right to Object: You may object to data processing based on our legitimate interests. If you do, we will stop processing unless we demonstrate compelling legitimate grounds or need the data for legal claims.
  • Right to File a Complaint: You may file a complaint with the supervisory authority: Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7.
